# ハーグ協定

ハーグ協定は意匠の国際登録制度です。この協定は、スイスのジュネーブにある世界知的所有権機関（WIPO）の国際局に提出された単一の国際意匠出願によって、いくつかの国および組織の工業意匠の保護を規定しています。意匠出願は、出願人が意匠保護を確保したい国を指定する必要があります。言い換えれば、各国で個別の国内出願を提出する代わりに、複数の国を指定して単一の国際意匠出願を提出することができます。

国際意匠登録は、指定された各国において、当該国で意匠が登録された場合と同じ効果があり、関連する国内法の対象となります。指定された国は、自国の法律の下で保護の対象とならない意匠を保護から除外する権利を保持します。

ハーグ協定の観点から、複数の意匠が単一の意匠出願に含まれる場合がありますが、その意匠に関連するすべての製品は、ロカルノ分類の同じクラスに分類される必要があります。指定国の国内法の観点から保護の対象とならないという理由で、登録意匠に対して取消手続が提起される場合があります。

現在、アフリカの14か国と地域組織OAPI（Organization Africaine de la Propriete Intellectuelle）がハーグ協定の締約国です。

アフリカの25か国は、ハーグの設計申請の対象となる可能性があります。のそれら **大胆な** OAPIのメンバーです。
