# OAPI –特許

## アフリカ知的財産機関

OAPI登録により、ベニン、ブルキナファソ、カメルーン、中央アフリカ共和国、チャド、コンゴ（共和国）、コモロス、赤道ギニア、ガボン、ギニア、ギニアビサウ、アイボリーコースト、マリ、モーリタニア、ニジェール、セネガル、トーゴ。

## PCT：

すべてのOAPI諸国は、特許協力条約を批准しています。したがって、PCT国際出願のOAPI地域フェーズには、すべての加盟国が自動的に含まれます。

第1章と第2章の締め切りは、優先日から30か月です。

## 特許性：

外科手術または治療による人体または動物の体の治療方法、ならびに診断方法は特許性がありません。ただし、そのような方法で使用する製品は特許を取得している場合があります。

## ノベルティ：

絶対的な新規性が必要です。ただし、発明の一般への開示が出願日の12か月前、または該当する場合は優先日の前に行われた場合、新規性は破棄されず、その結果、次のようになります。

- 公式または公式に承認された国際展示会で発明を表示するタイトルの申請者またはその前任者の、そのような展示会への参加を証明する公式に承認された証明書の作成を条件とする、または

- 申請者またはその前任者に関して第三者が犯した虐待。

## 提出要件：

発明の特許（非PCT）：

- 成年後見制度（署名のみ）（3か月以内に提出が遅れる可能性があります）

地域相PCT出願：

- 英語またはフランス語での明細書、クレームおよび要約（出願日に必要）

- 該当する場合は正式な図面（提出日に必要）

- 優先権の譲渡（6ヶ月以内に提出が遅れる可能性があります）

- 国際刊行物の写し（出願日に必要）

- 国際検索レポートのコピー（提出が遅れる可能性があり、期限は設定されていません）

- 特許性に関する国際予備報告書のコピー（提出が遅れる可能性があり、期限は設定されていません）

## 許す：

付与されると、特許はすべての加盟国で有効になります。この特許は、各加盟国のバンギ協定の規定に準拠します。特許の有効期間は20年です。

## リニューアル：

更新料は、出願日の1周年から毎年減額されます。

## 検査：

正式で実質的な審査があります。
