数年前の重要な判決（いわゆるClearvuの決定）で、南アフリカ最高裁判所（SCA）は、アドワーズ広告として競合他社の商標に入札する企業は、必ずしも違法な競争または商標権の侵害。 裁判所は、商標に入札する会社が、その商品またはサービスが商標の所有者に関連していると国民を故意に信じ込ませた場合にのみ、その行為は違法になると述べた。
