さまざまな形の先住民の知識と表現は、知的財産権の対象となる可能性があります。たとえば、天然資源から処方された医薬品または医薬品の新しい処方は、特許保護の対象となる可能性があります。新しい独自の方法で織られたバスケットまたはオブジェクトは、デザインとして、または著作権の下で保護の対象となる可能性があります。音楽、芸術、または文学作品は、著作権保護の対象となる可能性があります。また、場合によっては、製品の販売に使用される固有の起源を持つ単語が、商標としての保護の対象となることがあります。

知的財産権は資産であり、家の所有者が他の人に貸し出すことによって自分の財産権を利用できるのと同じように、所有者が自分の財産を利用するための手段を作成します。南アフリカでは、中小企業の経営者、伝統的なコミュニティ、または個々のクリエイターに、彼らの創造性や伝統的な表現を活用する方法についての教育はほとんど提供されていません。

何年にもわたって、多くの形式の先住民の知識と表現が第三者によって使用されており、それらの形式の表現または知識を作成した先住民コミュニティには補償が提供されていないか、ほとんどありません。これに応えて、世界中の多くの国が、伝統的な知識から利益を得ることができるように、伝統的なコミュニティに保護を提供する方向に動いています。

南アフリカでは、2013年の知的財産法改正法第28号が可決され、特定の伝統的および先住民の表現形式の認識と保護が規定されています。この法律の規定は、「先住民の文化的表現または知識」、「地理的表示」、「先住民コミュニティ」などの概念を定義しています。一言で言えば、この法律は、先住民の表現の形式を保護し、そのような表現が第三者によって使用されるときにコミュニティが相談および/または補償されることを保証することを目的としています。この補償と管理を容易にするために、この法律を介してさまざまな収集機関と機関が設立されています。この法律に関連する規則はまだ法制化されていないため、この法律がクリエイターを支援するかどうかはまだわからない。

株主の利益のために、文化的および先住民の表現や知識の形態を保護する必要があることは間違いありません。しかし現時点では、利用可能な知的財産法や制度を通じて文化的表現を保護する方法があることを人々が理解することが重要です。

さまざまな知的財産権の定義の多くは、文化的表現の形式を保護することを禁じていますが、柔軟性の余地があります。たとえば、特許としての保護の資格を得るには、発明は世界中で完全に新しいものでなければなりません。先住民の薬は何世紀にもわたって存在し、多くの人々に知られているので、これは特許としての保護からそれを失格にします。ただし、製剤がコミュニティによって製造、瓶詰め、ブランド化されている場合は、そのブランドとパッケージを著作権と商標で保護する余地があります。その製品および/または関連する知的財産は、そのメンバーの利益のためにコミュニティによって販売またはライセンス供与される可能性があります。
