# ケイマン諸島：新しい意匠権法

### ケイマン諸島は、新しい意匠権法を取得しています。 2019年2月19日に発行された意匠権法案2019（法案）は、現在の法律である意匠権登録法2016に代わるものです。

この法案は、ケイマン諸島における意匠権保護の近代化を含んでいるため、歓迎すべき進展です。法案がいつ発効するかは、現段階では不明です。

現在の法律は、英国で保有されている意匠権の延長を規定しています。法案が発効すると、最初に英国で意匠権を登録する必要がなくなります。

法案では、 '*設計'* 記事の全体または一部の形状または構成（内部または外部）として定義されます。法案の規定は、キット、つまり、組み立てられた物品に適用されるのと同じ方法で、物品に組み立てられることを目的としたコンポーネントの完全または実質的に完全なセットに適用されます。

登録可能性に関しては、除外事項があります。つまり、次のとおりです。

- 建設の方法または原則

- いずれかの物品がその機能を実行できるように、または物品がその物品である別の物品の外観に依存するように、物品を別の物品に接続するか、またはその周囲または反対に配置することを可能にする物品の形状または構成の特徴設計者が不可欠な部分を形成することを目的としています

新規性の要件は、デザインがオリジナルでなければならないということです。作成時に問題のデザイン分野で一般的である場合、デザインはオリジナルではありません。

意匠権の所有者は、その意匠に物品を作成することにより、またはそのような物品を作成できるようにする目的で意匠を記録した意匠文書を作成することにより、商業目的で意匠を複製する独占的権利を有します。デザインに記事を作成することによるデザインの複製は、そのデザインに正確にまたは実質的に記事を作成するためにデザインをコピーすることとして定義されます。

所有者の排他的権利には例外があり、意匠権は以下によって侵害されません。

- 個人的かつ非営利目的で行われる行為

- 実験目的で行われる行為

- 複製行為が実践と両立し、意匠の通常の利用を不当に害することがなく、出典が言及されている場合に限り、教育目的または引用を目的とした複製行為

意匠における著作権と意匠の重なりの可能性に対処する規定があります。

手続き面では、ファイリング言語は英語であり、オンラインファイリングはオプションではありません（これは明らかに検討されますが）。審査は手続きに限定されています。登録期間は、意匠が意匠書類に最初に記録された暦年、または意匠に最初に物品が作成された暦年のいずれか早い方の年末から15年です。年金は、最初の登録の年の後、毎年1月に毎年支払われます–追加料金付きの猶予期間があります。意匠権の最後の5年間、誰もが（権利の時点で）意匠権を侵害することを行うためのライセンスを取得する権利があります。
