ザンビア商標法のセクション17（1）は、同じ商品または商品の説明を対象とする事前登録に基づいて拒否を規定しています。ただし、セクション17（2）は、レジストラが、そうでなければ拒否されるマークの登録を許可する可能性があると述べています。 *「正直な同時使用またはその他の特別な状況の場合。」*

問題は、LAグループが以前に同じクラスのポロプレーヤーデバイスマークを登録したのに直面して、米国ポロ協会がクラス18と25のポロプレーヤーデバイスマークを登録する資格があるかどうかでした。レジストラは、セクション17（2）に基づいて登録を許可しました。問題は最終的にCAへの道を見つけました。
