IP protection in this sector spans everything from manufacturing ingredients and developing recipes, to labelling, marketing and branding the end product. Each form of IP protection – including trade marks, copyright, and patents – has a role to play in protecting brands and fostering innovation. What is more, an increasingly connected and engaged consumer has become a key driving force for change in the food and beverage industry within Africa, along with more challenging trading conditions and growing environmental awareness. Our specialist Food and Beverage team handles IP protection and enforcement for several very prominent companies in this sector, both local and global. We have extensive experience in managing IP portfolios and providing strategic advice, as well as providing appropriate ancillary services. These include advising generally on labelling requirements for foods, beverages and alcohol; assisting clients in bringing complaints against competitors who are non-compliant with relevant regulations; assisting clients in defending or bringing complaints before the Advertising Regulatory Board; assisting with licence/manufacture/supply and distribution agreements; and advising on matters relating to promotional competitions.
