a major step to safeguard intellectual property rights and strengthen efforts against counterfeiting, the Tanzania Fair Competition Commission (FCC) has introduced a mandatory trade mark recordation programme due to come into effect from December 2025. This follows the recent publication of the Merchandise Marks (Recordation) Regulations, 2025, which came into force on 1 July 2025 giving effect to the provisions of the Merchandise Act of 1963 (as amended). Spoor & Fisher Partner, [Paul Ramara](https://spoor.com/our-people/paul-ramara/), met with the FCC on 17 September 2025 to discuss various elements of the proposed recordal programme. Paul spearheads our Africa Anti-Counterfeiting practice. Brand owners should note the following: - All trade marks relating to goods imported into Tanzania (Mainland) must be recorded. - Applications for the recordal of trade marks must be submitted to the Chief Inspector for review and subsequent approval/rejection. - The Regulations make specific reference to Mainland Tanzania. Therefore, they do not apply to Zanzibar. The following is required to file a recordal application: - Full details of the entity wishing to record the trade mark, including, *inter alia*, company incorporation details, business address(es), and contact details. - Full details of any subsidiary or affiliate entities under common ownership of the trade mark. - Particulars of any foreign persons or entities licensed to use the trade mark, and the nature of such authorised use (i.e., distributors). - Copies of all registered trade mark certificates. - Classes of interest. - The details of at least one manufacturer, in Tanzania or anywhere else. - Photographic representation of all the goods bearing the trade marks. - Power of Attorney.
