英国于 2020 年 1 月 31 日正式离开欧盟，但过渡期一直持续到 2020 年 12 月 31 日，并且有可能延长。关于英国退欧对知识产权的影响的文章很多。

## 欧盟外观设计注册持有人

一个鲜为人知的后果是，欧盟外观设计注册、注册共同体外观设计 (RCD) 的持有人在英国退欧后最终可能会扩大地理覆盖范围——这包括国际外观设计注册（根据海牙协定）的所有者，他们指定了欧洲联盟。与未决 RCD 申请的所有者一样。

在过渡期结束时，将自动创建一个新的英国外观设计注册以对应每个 RCD。此外，在过渡期的最后一天有 RCD 申请待决的任何人都有权提交相应的英国申请，并且新的英国申请将保留 RCD 申请的提交日期和/或优先权日期。这个过程被称为'*克隆'。*

### 英国外观设计注册

一个没有引起太多关注的问题是，英国外观设计注册自动涵盖（或在少数情况下可能涵盖申请）许多其他国家或司法管辖区，这并不适用于 RCD。这样做的结果是，新创建的英国注册（前 RCD）的所有者以及相应英国申请的所有者（如上一段所定义）最终可能会扩大地理覆盖范围。

我们之所以说“*可能*' 而不是 '*将要'* 是存在一些不确定性。退出协议第 54 条允许设立“a* 在英国可比的注册和可执行的知识产权*'，但没有明文规定可能扩大地理覆盖范围。这就提出了一个问题，即与原始 RCD 注册相比，提供更多地理覆盖潜力的克隆英国注册是否真的是“*可比*'？答案有待解释，在过渡期之后可能需要司法介入。
