# 面对音乐：这到底是谁的歌？

**相似性是一个问题吗？**

但是很多歌都是 *相似的* 这可能是有问题的。它们是否足够相似以致侵犯版权？如果是这样，是否值得提起诉讼？

**一切都与原创有关**

这很棘手，因为音乐家通常没有能力处理商业事务——而且往往缺乏获得高质量、专业法律指导的资源。

**给音乐人的一些建议**

如果您是音乐家，这里有一些建议：

未经他人许可，请勿复制/使用/采样其他人的歌曲。请检查您的合同，尽量与出版商协商条款（他们会容忍），并确保您提供的任何承诺或保证（担保）“以我所知”为前提.

在为自己的作品申请版权时，您应该知道版权是自动存在的；音乐不需要正式形式的版权登记。

您需要做的就是通过以下方式证明您是创造者：

显示有关工作进展的支持证据（早期草稿、草图、概要、粗略录音等）；  **确保您的作品有正确的标记和日期（有些音乐家甚至将自己的作品邮寄给自己，以记录创作日期）；和，

在合资企业的情况下，以书面形式明确规定谁将拥有什么权利以及当有人退出合伙企业时会发生什么。

底线是什么？ **
为避免在您自己的音乐创作中出现模糊的界限，这里有一些建议：未经他人书面许可，请勿对他人的音乐进行采样。此外，不要落入被一首音乐如此启发的陷阱，以至于您让其中的一点点潜入您的音乐中。
