# 非洲植物育种者权利的发展

### 目前有可能在 28 个非洲国家获得有效的植物育种者权利 (PBR) 保护：

- 埃及、埃塞俄比亚、肯尼亚、摩洛哥、卢旺达、南非、坦桑尼亚和桑给巴尔、突尼斯、赞比亚和津巴布韦都有国家法律和办公室来提交、授予和执行 PBR。

- 贝宁、布基纳法索、喀麦隆、中非共和国、乍得、刚果（共和国）、科摩罗、赤道几内亚、加蓬、几内亚、几内亚比绍、象牙海岸、马里、毛里塔尼亚、尼日尔、塞内加尔和多哥通过区域 OAPI（非洲知识产权组织）系统。 OAPI 注册自动扩展到所有成员国。既没有必要也没有可能指定个别成员国。 OAPI 法律适用于所有成员国。成员国没有自己的国家法律。任何成员国的国家法院就 OAPI 法律条款作出的决定对所有其他成员国具有约束力。

### 加纳

2020 年 11 月 9 日，旨在建立法律框架以保护植物新品种或植物群育种者的权利并促进加纳植物新品种育种的《2020 年植物品种保护法案》获得通过。我们正在等待总统批准和印刷法律，以及实施该法律的条例。可能需要一段时间才能在加纳申请 PBR 保护。

### SADC – 植物新品种保护协议

南部非洲发展共同体（SADC）是一个政府间组织，总部位于博茨瓦纳哈博罗内。其目标是促进南部非洲16个国家之间的区域社会经济合作和一体化以及政治和安全合作。南共体成员国是安哥拉、博茨瓦纳、科摩罗、刚果（DR）、埃斯瓦蒂尼、莱索托、马达加斯加、马拉维、毛里求斯、莫桑比克、纳米比亚、塞舌尔、南非、坦桑尼亚、赞比亚和津巴布韦。

2020 年 6 月 29 日，博茨瓦纳签署了 SADC 植物新品种保护议定书（植物育种者权利）。博茨瓦纳是南共体第九个签署该议定书的成员国（其他签署国为安哥拉、刚果民主共和国、埃斯瓦蒂尼、莱索托、莫桑比克、纳米比亚、坦桑尼亚和赞比亚）。根据议定书第 44 条，它将在南共体三分之二成员国签署后 30 天生效。目前有十五个南共体成员国。南共体议定书将在十个成员国签署后生效。

一旦 SADC 植物新品种保护议定书生效，它将为签署国的 PBR 保护提供区域体系。每个成员国都需要有国家 PBR 立法才能使保护有效。

### ARIPO——阿鲁沙议定书

非洲地区知识产权组织 (ARIPO) 是一个在成员国提供专利、商标和注册外观设计保护的地区体系。目前 ARIPO 成员国有博茨瓦纳、埃斯瓦蒂尼、冈比亚、加纳、肯尼亚、莱索托、利比里亚、马拉维、莫桑比克、毛里求斯、纳米比亚、卢旺达、圣多美和普林西比、塞拉利昂、索马里、苏丹、坦桑尼亚联合共和国、乌干达、赞比亚和津巴布韦。应该指出的是，并非所有国家都签署了专利和外观设计的哈拉雷议定书和/或商标的班珠尔议定书。即使一个国家是 ARIPO 的成员，只有在该国加入了哈拉雷和班珠尔议定书的情况下，才能通过 ARIPO 获得专利、外观设计和商标保护。此外，与 OAPI 的单一申请自动涵盖所有成员国并且不可能指定感兴趣的国家不同，ARIPO 申请特别要求申请人指定需要保护的成员国。 ARIPO 授予的专利、设计或商标在每个指定国与根据适用的国内法注册、授予或以其他方式具有效力的专利、设计或商标具有相同的效力。根据国家法律，已授权的 ARIPO 专利、外观设计或商标的执行在国家范围内进行。

2015 年 7 月 6 日，ARIPO 成员国外交会议在坦桑尼亚阿鲁沙通过了《阿鲁沙植物新品种保护议定书》。圣多美和普林西比、冈比亚、加纳和莫桑比克于 2015 年 7 月 6 日签署了阿鲁沙议定书，坦桑尼亚随后于 2015 年 9 月 28 日签署了该议定书。 任何属于 ARIPO 的国家或任何对 21 个 ARIPO 成员开放的国家可以通过签署并交存批准书的方式成为《阿鲁沙议定书》的缔约方；或通过交存加入书。 ARIPO 的成员资格对联合国非洲经济委员会的所有成员国开放。

卢旺达于 2019 年 6 月 7 日交存了《阿鲁沙议定书》的加入书，圣多美和普林西比于 2020 年 9 月 29 日交存了批准书。

《阿鲁沙议定书》将在四个国家交存批准书或加入书十二个月后生效。

《阿鲁沙议定书》一旦生效，还将为签署国保护 PBR 提供区域体系。每个成员国都需要有国家 PBR 立法才能使保护有效。

总而言之，2020 年 SADC 植物新品种保护议定书和阿鲁沙植物新品种保护议定书均有进展。南共体议定书（由安哥拉、博茨瓦纳、刚果民主共和国、埃斯瓦蒂尼、莱索托、莫桑比克、纳米比亚、坦桑尼亚和赞比亚签署）只需要再增加一个南共体成员国； ARIPO 阿鲁沙议定书（卢旺达和圣多美和普林西比已加入/批准）需要另外两个国家加入或批准。

《阿鲁沙议定书》的优势在于，ARIPO 已经设立了一个接收、处理和授予专利申请的办公室，并且应该能够为 PBR 建立一个类似的系统（就像在 OAPI 所做的那样）。 《阿鲁沙议定书》还制定了实施细则。规定 ARIPO 依靠其他 PBR 局的 DUS 测试结果，或委托缔约国任何主管机构或提供有效植物新品种保护体系的政府间组织的任何成员进行技术审查，以获得授权。饲养员是对的。 《阿鲁沙议定书》面临的一个挑战是，它迄今为止只有两个国家加入/批准。

南共体议定书的优点是已经有九个成员国签署，再有一个成员国签署后生效。 SADC 协议面临的一个挑战是需要设立 SADC PBR 办公室来接收、处理和授予 PBR 申请。规定 SADC PBR 办公室与 SADC 区域内外的任何相关机构或人员达成协议，进行 DUS 测试，或者可以使用该机构已经进行的此类测试的结果或人。

这两个系统面临的另一个挑战是，那些尚未制定保护植物育种者权利的国家法律的国家将需要颁布国家 PBR 法律才能使保护有效。

ARIPO 阿鲁沙协议和 SADC 协议是否都将得到实施还有待观察。目前这两个系统都在向前推进，更多的国家正在制定保护植物新品种的法律。未来，我们希望看到更多的非洲国家为新的植物品种提供保护。
