# OAPI – 专利

## 非洲知识产权组织

OAPI 注册在以下国家提供保护：贝宁、布基纳法索、喀麦隆、中非共和国、乍得、刚果（共和国）、科摩罗、赤道几内亚、加蓬、几内亚、几内亚比绍、象牙海岸、马里、毛里塔尼亚、尼日尔、塞内加尔和多哥。

## PCT：

所有 OAPI 国家都批准了专利合作条约。因此，PCT 国际申请的 OAPI 地区阶段将自动包括所有成员国。

第一章和第二章的截止日期是从优先权日起三十个月。

## 可专利性：

通过手术或疗法治疗人体或动物体的方法以及诊断方法不可申请专利。然而，用于任何此类方法的产品可能获得专利。

## 新奇：

需要绝对的新颖性。但是，如果发明向公众公开的时间不早于申请日或优先权日（如适用）之前的十二个月，则新颖性不会被破坏，并且结果是：

- 申请人或其前任在官方或官方认可的国际展览会上展示发明，但须出示官方认可的证明参加此类展览会的证书，或

- 第三方对申请人或其前任权利的滥用。

## 备案要求：

发明专利（非PCT）：

- 授权书（简单签名）（可在三个月内延迟提交）

- 英文或法文的说明书、权利要求和摘要（提交日需要）

- 正式图纸，如果适用（提交日需要）

- 优先权的转让（可以在三个月内延迟提交）

- 带有经过验证的英文或法文翻译的优先权文件（可在六个月内延迟提交）

地区阶段PCT申请：

- 授权书（简单签名）（可在三个月内延迟提交）

- 英文或法文的说明书、权利要求和摘要（提交日需要）

- 正式图纸，如果适用（提交日需要）

- 优先权的转让（可以在六个月内延迟提交）

- 国际公布副本（申请日需要）

- 国际检索报告副本（可以延迟提交，没有设定截止日期）

- 关于可专利性的国际初步报告副本（可以延迟提交，没有设定截止日期）

## 授予：

授予后，专利在所有成员国生效。该专利受各成员国班吉协定的规定管辖。专利期限为二十年。

## 续订：

续展费从申请日的第一个周年起每年到期。

## 考试：

有形式审查和实质审查。
