# OAPI – 注册外观设计

## OAPI – Registered Designs – Background:

1962 年，根据《利伯维尔协定》，在非洲前法国殖民地申请专利和商标保护的中央办公室首次成立。该办公室后来被称为“非洲与马尔加什工业产权局”(OAMPI)。 1977 年通过了一项名为《班吉协定》的新协议，该局更名为“非洲知识产权组织”（OAPI），也称为非洲知识产权组织（AIPO）。根据 2002 年 2 月 28 日（也在中非共和国班吉）达成的另一项协定，通过了《班吉协定》的修订版，并被视为每个成员的国家法律及其附件一十关于专利、实用新型、商标、工业品外观设计、商业名称、地理标志、版权、反不正当竞争保护、集成电路布图（设计）和植物品种保护的国家。

## 国际公约的成员：

- OAPI 是巴黎公约的成员。

- OAPI 成为海牙协定的缔约方，自 2008 年 9 月 16 日起生效。

## OAPI 会员资格：

OAPI 有 17 个成员国，包括：贝宁、布基纳法索、喀麦隆、中非共和国、乍得、科摩罗（马约特岛除外）、刚果、赤道几内亚、加蓬、几内亚、几内亚比绍、科特迪瓦、马里、毛里塔尼亚、尼日尔、塞内加尔和多哥。 OAPI 设计申请自动涵盖所有成员国，并且无法指定感兴趣的国家。

## 新颖性要求：

在申请日之前或（如适用）在注册申请的优先权日之前，通过以有形形式公布、使用或以任何其他方式在世界任何地方进行的任何披露都会破坏新颖性。如果在上述日期之前的 12 个月内，工业品外观设计因以下原因被公开，则不得否认其新颖性：

(a) 与申请人或其前任有关的明显违反；或者

(b) 申请人或其前任在官员或      官方认可的国际展览。

## 可注册性：

任何线条或颜色的排列均应视为设计，任何三维形状，无论是否与线条或颜色相关联，均应视为模型，前提是该排列或形状赋予工业或工艺产品特殊的外观并且可以作为制造这种产品的模式。

如果该客体可以同时被认为是新设计和可专利发明，并且构成外观设计新颖性的要素与发明的要素不可分割，则该客体只能作为专利或实用新型受到保护。

工业品外观设计的实施违反公共政策或道德的，不得注册，但有一项理解是，对外观设计的商业利用不会仅仅因为其被法律或监管规定禁止而被视为违反公共政策或道德.

同一份申请可以包括 1 到 100 种外观设计，这些外观设计应从头到尾编号，前提是它们属于国际分类（洛迦诺协定）的同一类或同一组或同一系列的物品。

## 备案要求：

- 授权书（可以延迟提交）。

- 外观设计的图纸或照片（提交当天需要）。

- 新颖性的描述/声明（提交当天需要）。

- 优先权文件（可以在提交后三个月内延迟提交）。

- 如果不是英文或法文，则优先权文件的宣誓翻译（可以在提交后三个月内延迟提交）。

- 优先权转让，如果适用（可以在提交后三个月内延迟提交）。

- 如果不是英文或法文，则优先分配的宣誓翻译。

- 国际分类详情（可在提交后三个月内延迟提交）。

## 延期出版：

可能在申请的申请日后不超过十二个月的期间内，或在要求优先权的优先权日后的期间内。

## 持续时间和更新：

OAPI 外观设计注册的初始期限为自申请日起五年。该期限可在支付所需费用后延长两个期限，每个期限为五年。
