# 巴黎公约

《保护工业产权巴黎公约》是保护知识产权的各种多边条约中的第一个，也可以说是最重要的条约之一。 《巴黎公约》的实质性条款主要分为国民待遇、优先权和共同规则三大类。

《巴黎公约》适用于最广泛意义上的知识产权，包括专利、商标、工业品外观设计、实用新型、服务商标、商号、地理标志和对不正当竞争的压制。 《巴黎公约》规定，在知识产权保护方面，每个缔约国必须给予其他缔约国国民与其本国国民相同的保护。当申请人在联盟的外国成员提交申请，例如专利或商标时，该申请将受到与来自该外国国民的同等待遇。

最重要的是，《巴黎公约》包含了“公约优先权”的重要概念。它规定来自一个缔约国的申请人可以将其第一个申请日（在一个缔约国）作为在另一缔约国的有效申请日，前提是申请人或其权利继承人提交了后续申请。在首次申请后 6 个月（工业品外观设计和商标）或 12 个月（专利和实用新型）内提出申请。

Currently, the majority of African countries are members of the Paris Convention except for Cape Verde, Eritrea, Somaliland, Somalia, South Sudan and St Helena.
