# 南非：与化妆品标签、广告和成分有关的修订法规草案

2016 年 8 月 19 日，南非卫生部根据 1972 年第 54 号食品、化妆品和消毒剂法案发布了与化妆品标签、广告和成分相关的法规草案。

概括而言，这些条例草案规定：

- 化妆品类别；

- 确保这些产品安全的措施；

- 一个强制性的产品信息文件；

- 良好生产规范;

- 化妆品成分中的禁用物质；

- 标签要求；

- 产品声明；

- 广告;和

- 处罚。

除其他条款外，条例草案规定，任何人不得销售、制造或进口任何“在正常或合理可预见的使用条件下使用时可能对人体健康造成损害”的化妆品。此外，规定制造商、包装商和分销商必须为每种化妆品保留产品文件，并且商品的制造必须符合良好生产规范 (GMP)。

此外，产品不得含有任何禁用物质（这些物质列在法规草案中），并且禁止误导或欺骗性声明。

条例草案还规定了新的刑事犯罪。例如，根据这些规定，将产品贴上“医生推荐”标签或暗示产品是医生推荐的产品是违法的。

对拟议条例的书面意见和评论必须在本草案公布后三个月内提交，即通过 **2016 年 11 月 19 日**.
